1. Who we are

The Platform is operated by Domexa Technologies Ltd, a company registered in Kenya (the “Company”, “we”, “us”). You can reach us using the contact details at the end of this document.

2. Accounts and eligibility

You must be at least 18 years old and able to enter a binding contract to use the Platform. There are three self-service roles: home-seekers (who browse and book viewings), listers (landlords or brokers who publish properties), and riders (who conduct viewing tours).

Accounts are secured by one-time codes (OTP) sent to your phone and, for listers, your email. You are responsible for keeping access to your phone and email secure, and for all activity under your account.

3. Lister verification and publishing

To reduce fraud, listers must verify both a phone number and an email address before an account is created, and must complete identity verification (KYC) — including a National ID and, for brokers, a KRA PIN and registered business name — before any listing can be published.

You may not publish a listing until your identity has been verified and approved. We may refuse, delay, suspend or revoke verification at our discretion, and may re-verify at any time.

4. Lister obligations

You confirm that every property you list is genuine, currently available, and that you are the owner or are lawfully authorised to list it. Photos, prices, locations and descriptions must be accurate and up to date.

You must promptly update or remove a listing once a property is no longer available. Providing false, misleading or duplicate listings is a serious breach of these Terms.

5. Prohibited conduct

You must not: post fraudulent, fake or misleading listings; impersonate another person or business; collect payments or deposits through deception; harass other users; scrape or misuse Platform data; attempt to bypass verification or security controls; or use the Platform for any unlawful purpose.

We may remove content, restrict features, suspend or terminate accounts, and report activity to the relevant authorities where we reasonably suspect fraud or abuse.

6. Viewing tours and riders

Home-seekers may book viewing tours conducted by independent riders. Riders are independent providers, not our employees. We facilitate the booking but do not guarantee the conduct of any rider, lister or seeker.

You are responsible for your own safety and conduct during viewings, and for verifying a property and any agreement independently before making payments.

7. Fees

Creating a lister account is currently free. Some services (for example viewing tours or promoted listings) may carry fees, which will be shown before you commit. We may change fees on reasonable notice.

8. Content and intellectual property

You retain ownership of content you submit (such as listing photos), and you grant us a licence to host, display and promote it in connection with the Platform. You must have the rights to any content you upload.

The Platform, its branding and software are owned by the Company and protected by law. You may not copy or reuse them without permission.

9. Suspension and termination

You may stop using the Platform at any time. We may suspend or terminate your access if you breach these Terms, if we suspect fraud, or as required by law. Verified listings may be unpublished on suspension or termination.

10. Disclaimers and liability

The Platform is provided “as is”. We do not warrant that listings are accurate or that any transaction will be successful, and we are not a party to agreements between users. To the maximum extent permitted by law, we exclude liability for losses arising from your use of the Platform or your dealings with other users.

Nothing in these Terms limits liability that cannot be limited under Kenyan law.

11. Governing law

These Terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of the Kenyan courts.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and, where changes are material, notify you. Continued use after changes take effect means you accept them.
